Decree-Law No. 1/2026 of 30 July approves a new Legal Regime for Insurance, replacing the regime under Decree-Law No. 1/2010 of 31 December and introducing significant changes to the framework for insurance and reinsurance activity in Mozambique. The Mozambican Insurance and Pension Funds Supervisory Authority (ASFPM) now concentrates licensing, supervision, regulation, inspection and enforcement powers, including authorisation to incorporate insurance and reinsurance companies, which previously depended on the Minister responsible for Finance. Market access becomes more demanding: minimum share capital now ranges from 45 to 97 million Meticais for Non-Life, 196 million for Life and 295 million where both are carried out, and certain corporate changes require prior authorisation. The decree also strengthens the rules on governance, risk management, internal control and solvency, reinforces market conduct — with complaint-handling mechanisms and a Customer Ombudsman —, subjects reinsurance programmes to prudential scrutiny, expressly prohibits fronting operations and structures the recovery, reorganisation and winding-up mechanisms.
